Lesson 2

Kitab al-Taharah


Kitab
Literal Meaning - refers to Jam'a (to gather)
Technical Meaning – Gathering of Masaail related to a particular topic, ex. Kitab al-Taharah

Kitab can come with either a fatha, dhammah or kasrah
You can read it as Tahaarah, Tihaarah and Tuhaarah
Tahaarah literal meaning is to clean and the technical meaning is too clean yourself from Hadath al-Akbar and hadath al-asghar.

Imam Qudoori is starting the book with a proof (Ayah of Qur’an) for barakah.

You read it Arjulakum because it is atf to Wa aydiyaakum
According to another qira’ah you can read it Arjulikum, the meaning will remain the same.

Literal meaning of Fardh – To count something
Technical Meaning – Something that is established emphatically through Qati al-Dalaalah (established directly from Qur’an or from mutawaatir hadith) and Qati al-Thuboot

The four actions mentioned in the ayah will be compulsory and nothing else.

Why is the elbow and ankle included?
In arabic, if the word coming after “ila” is part of what is coming before “ila”, then it is considered included.

This is the daleel against Imam Zufar Rahimullah.

Hishaam narrates from Imam Muhammad Rahimullah, that ka’ab refers to the bone on top of your foot (versus the ankle). This however is a error of Imam Hishaam rahimullah because he took the meaning of ka’ab from the chapter of Ihraam. (In which the bone on top of the foot needs to remain exposed)

Nasiah is the amount compulsory in washing the head. Nasiah refers to 1/4th of the head. This is the preferred view narrated from Imam Abu Hanifa (via Imam Tahawi and Imam Karkhi)

However, Imam Hishaam narrates from Imam Abu Hanifa that you only have to wipe three fingers, but the former position is preferred.

Imam Qudoori moves on to Sunnah’s of wudhu.
1. Washing hands before entering them into a vessel if you’ve just woken up from sleep. However according to al-Hidayah and Jawharah washing the hands is always sunnah (al-Tasheeh wa al-Tarjeeh)
2. Take the name of Allah before starting wudhu, according to al-Hidayah it is mustahab (view of al-Hidayah is preferred)
3. Al-Siwaak, if no siwaak, then to use the fingers (al-Hidayah: the more correct view is that it is mustahab)
4. Rinsing your mouth
5. Cleaning your nose
The above two must be done with 3 scoops of water (according to some scholars its ok 1 scoop for nose)
6. Wipe the ears without taking fresh water (stronger view in the madhhab)
7. Khilal of beard, this is the view of Imam Abu Yusuf, according to Imam Abu Hanifa it is mearly allowed, and also say “hadha min amari rabi”
8. Khilal of fingers (the sunnah method is to make khilal of your fingers after washing your hands for masah of your head)
9. Washing every area three times

Mustahabbaat of Wudhu


Mustahabaat of Wudhu
1. Make intention of Tahaarah
2. Wipe the whole head
3. Wudhu in order

According to some scholars these are actually sunnah (Muheet al-Burhani & al-Hidayah)

4. Mustahaab to start with the right side

5. Doing wudhu in a continuously
6. To wipe the nape

Nawaqidul Wudhu

1. Everything that comes out of the private organs
2. Blood coming out (hanaabilah also)
3. Pus coming out
Yulhiquhu Hukm al-Tatheer – refers to the places obligatory to wash in ghusl (which are: entire body, inside the mouth and nose)
4. Vomit more than a mouthful
Mouthful will be considered when you cannot keep it in, if you are able to keep it in, then it will be considered little and will not break your wudhu.

Vomiting little, but multiple times
Imam Muhammad will take into consideration Ittihaad al-Sabab
Imam Abu Yusuf will take into consideration Ittihaad al-Majlis

Imam Abu Yusuf, says if it comes from your stomach, then it breaks wudhu,
5. Sleeping while lying down, or leaning against something.
Preferred view in the Hanafi madhab, if you are leaning against something and you are seated on something, then your wudhu will not break (Bahr al-Raaiq & Radd al-Muhtaar)
6. If your mind is overpowered, ie fainting
7. Junoon – Going mad
8. Qahqaha, laughing loudly in every salah that has ruku and sajdah

3 Types of Laughs
Tabassum – Smile without a sound
Al-Dihq – You can hear yourself, not anyone else
Al-Qahqaha – Those around you can also hear

Salaah only breaks in the last one
